Do you need planning permission for a conservatory?

In most cases, the answer to this question is no. However, there will be some properties in the East Midlands where permitted development rights cannot be used for building a conservatory. Unfortunately, if you live in a flat, listed building, or a conservation area, you may need planning permission to go ahead to ensure you adhere to building regulations.

Owners of homes in new developments may also be restricted by their contracts. However, if you are eligible for a conservatory, as long as the set building regulations are followed, you will not need to apply for planning permission – the requirements include:

  • The conservatory must not extend beyond the rear of the existing house by more than 4 metres if your home is detached.
  • The conservatory must not extend beyond the rear of the existing house by more than 3 metres if your home is semi-detached or you live in a terraced property.
  • It should only be one-storey, with a maximum height of 4m.
  • The conservatory should take up less than 50% of the land around the original house – ‘Original’ being the land that was there when it was built or as it stood on the 1st July 1948.
  • The roof cannot be higher than the eaves of your property’s roof.
